OFFICE SEARCH: The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d). TMEP section 704.02.

In accordance with the authorization granted by Gary Mohr on February 19, 2004, the application has been AMENDED as indicated below. If the identification of goods or services has been amended, please note that any future amendments must be in accordance with 37 C.F.R. 2.71(a); TMEP section 1402.07(e). Standard Character Claim :
The following standard character drawing claim is added to the record:
The mark is presented in standard character without claim to any particular font style, size, or color.

Claim of Prior Registration :
The applicant is the owner of U.S. Registration No. 2558628.
This case will be given priority as an amended case if you respond to the requirements stated below within two months.
Substitute Specimens :
Applicant must submit a substitute specimen showing use of the mark for the goods specified in the application; because the specimen currently of record does not show use of the mark for any goods identified in the application. 37 C.F.R. §2.56; TMEP §904. Applicant must also submit a statement that “the substitute specimen was in use in commerce at least as early as the filing date of the application,” verified with a notarized affidavit or a signed declaration under 37 C.F.R. §2.20. 37 C.F.R. §2.59(a); TMEP §904.09.
The current specimen of record comprises of applicant’s letterhead which shows the proposed mark appearing on the top left. It does not show use for applicant’s goods because it makes no reference to applicant’s goods. Examples of acceptable specimens for goods are tags, labels, instruction manuals, containers, photographs that show the mark on the goods or packaging, or displays associated with the goods at their point of sale. TMEP §§904.04 et seq.
Fee Increase :
Fee increase effective January 1, 2003. Effective January 1, 2003, the fee for filing an application for trademark registration will be increased to $335.00 per International Class. The USPTO will not accord a filing date to applications that are filed on or after that date that are not accompanied by a minimum of $335.00.
Additionally, the fee for amending an existing application to add an additional class or classes of goods/services will be $335.00 per class for classes added on or after January 1, 2003.
