In accordance with the authorization granted by Norman Roth on February 18, 2004, the application has been AMENDED as indicated below. Please note that if the identification of goods or services has been amended below, any future amendments must be in accordance with 37 C.F.R. 2.71(a); TMEP section 1402.07(e). No response is necessary unless there is an objection to the amendment. If there is an objection to the amendment, the applicant should notify the examining attorney immediately.
The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.
No claim is made to the exclusive right to use “COMPANY” apart from the mark as shown.
The classification and identification of goods is amended to read as follows:
“Sports sunglasses, baseball batting helmets and catchers’ helmets in International Class 9;”
“All purpose sports and athletic bags, baseball and softball equipment bags, backpacks and tote bags in International Class 18;”
“Clothing and footwear for playing baseball and softball, namely pants, jerseys, uniforms, caps, pullovers, shorts, tee shirts and wristbands in International Class 25;”
and “Articles and equipment for use in playing baseball and softball, namely, bats, bat replacement grips, bat weights, applicators containing rosin and pine tar, ball gloves and mitts and repair parts and kits therefore comprised mainly of rawhide lace and a needle, batting gloves; body protectors and pads for baseball and softball players, namely catchers’ masks, chest protectors, leg guards, knee cushions, forearm, shin, wrist and hand protectors, sliding pads and protective wrist pads; ball batting and training nets, pitching targets, batting tees, balls, umpires' equipment kits comprised mainly of an umpire indicator and brush in International Class 28.”
