Applicant requested reconsideration of the final refusal dated July 31, 2004.
Upon careful review of the request for reconsideration, the trademark examining attorney finds the arguments set forth therein unpersuasive and determines that no new issue has been raised and no new compelling evidence has been presented with regard to the point(s) at issue in the final action. TMEP §715.03(a). The requirement is therefore continued.
The applicant’s identification of goods is acceptable as amended.
The application lists more than one party as the applicant. It appears, however, that applicant is a partnership. If so, the application must be amended to identify applicant by its legal name, using the following format: “__________, a partnership organized under the laws of ______________, composed of __________.” TMEP §803.03(b). Applicant must list all general partners and their national citizenship (for individuals) or U.S. state or foreign country of organization or incorporation, as appropriate. 37 C.F.R. §2.32(a)(3)(iii); TMEP §§803.03(b) and 803.04.
This requirement is final.
Please note that the only appropriate responses to a final action are either (1) compliance with the outstanding requirements, if feasible, or (2) filing of an appeal to the Trademark Trial and Appeal Board. 37 C.F.R. §2.64(a). If the applicant fails to respond within six months of the mailing date of this refusal, this Office will declare the application abandoned. 37 C.F.R. §2.65(a).
