SEARCH OF THE RECORDS

DISCLAIMER

Applicant must disclaim the descriptive wording “MEMORY TRAINING” apart from the mark as shown because it merely describes the subject matter and/or purpose of the therapy.  Trademark Act Section 6, 15 U.S.C. §1056; TMEP §§1213 and 1213.03(a).

The computerized printing format for the Office’s Trademark Official Gazette requires a standardized format for a disclaimer.  TMEP §1213.08(a)(i).  The following is the standard format used by the Office:

No claim is made to the exclusive right to use “MEMORY TRAINING” apart from the mark as shown.

IDENTIFICATION OF GOODS AND/OR SERVICES

The recitation of goods and/or services is unacceptable because the precise nature of the good and/or services is not clear from the present wording.  Clarify the type of therapy using common commercial names, e.g. occupational therapy.

The applicant may wish to consult the on-line identification manual on the PTO homepage for a searchable database of acceptable identifications for goods and/or services.  The manual is available at:  http://www.gov.uspto.report/web/offices/tac/doc/gsmanual.

Please note that, while the identification of goods and/or services may be amended to clarify or limit the goods and/or services, adding to the goods and/or services or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include goods and/or services that are not within the scope of the goods and/or services set forth in the present identification.

The applicant may adopt the following recitation, if accurate:

International Class 44:  [CLARIFY the type of therapy services using common commercial names, e.g. occupational therapy] in the nature of information recall enhancement therapy for Alzheimer’s or other memory-impaired patients.

TMEP section 1402.01.
