The assigned trademark examining attorney has reviewed the referenced application filed on July 2, 2003, and has determined the following:

Search Results

The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

2(e)(2) - Geographically Descriptive Refusal

Registration is refused because the mark is primarily geographically descriptive of the origin of applicant’s services.  Trademark Act Section 2(e)(2), 15 U.S.C. §1052(e)(2); TMEP §§1210.01(a) and 1210.04(b).

A two-part test is applied to determine whether a mark or term is geographically descriptive.  First the term must be the name of a place known generally to the public.  Second, the public must be likely to make a services-place association, i.e., believe that the services originate from that location.  In re California Pizza Kitchen, 10 USPQ2d 1704, 1705 (TTAB 1989) (goods); In re MCO Properties, Inc., 38 USPQ2d 1154, 1155 (TTAB 1995) (services).

The attached evidence from the American Heritage Dictionary[1] shows that the primary significance of the term “DOVER” is the name of a geographic location that the public generally knows.  In addition, the specimens of record confirm that the mall is located in Dover (Delaware).  The public is likely to believe the services originate from that place because the mall is located in Dover.  Further, that geographic location is not remote or obscure, nor does the term have any other significant non-geographic meaning.  Thus there is a presumed services-place association.  See In re California Pizza Kitchen, 10 USPQ2d 1704 (TTAB 1989); In re Handler Fenton Westerns, Inc., 214 USPQ 848 (TTAB 1982).

The addition of a highly descriptive or generic term to a geographic term does not serve to obviate a determination of geographic descriptiveness.  See In re JT Tobacconists, 59 USPQ2d 1080 (TTAB 2001); In re Carolina Apparel, 48 USPQ2d 1542 (TTAB 1998); In re Chalk’s International Airlines Inc., 21 USPQ2d 1637 (TTAB 1991); In re Wine Society of America Inc., 12 USPQ2d 1139 (TTAB 1989); In re California Pizza Kitchen Inc., 10 USPQ2d 1704 (TTAB 1988); In re Cambridge Digital Systems, 1 USPQ2d 1659 (TTAB 1986); In re BankAmerica Corp., 231 USPQ 873 (TTAB 1986); TMEP §1210.07(a).  In this case, the addition of the term COMMONS, which is a descriptive term in the context of shopping malls, does not obviate the fact that DOVER COMMONS is primarily geographically descriptive.  See attached articles from the Lexis-Nexis® database.

Although the trademark examining attorney has refused registration, applicant may respond to the refusal to register by submitting evidence and arguments in support of registration.

Regarding safety and confusion at that spot, where traffic leaving the mall can go either to Crossgates Commons or to Washington Avenue Extension westbound, we've got good news. He said a groundskeeper straightened the stop sign, and a contractor will install a larger reflective arrow pointing to Washington Avenue Extension. As to lighting, he said, "we'll look into that."

I'm not saying anything new when I call Central Jersey a shopping jungle.

Behind every bush, beneath every stone, there are department stores and malls and promenades and "shoppes" and commons and strip malls and villages and towne centers and plazas and junctions and ... you get the idea.

But there's no jungle like the new Kohl's in Hillsborough. It gives new meaning to "survival of the fittest."

HEADLINE: The best of mall worlds Geneva Commons to combine upscalestores, Chicago restaurants and easy parking

BYLINE: Tona Kunz Daily Herald Staff Writer

BODY:

To Carolyn Wirsing, the opening Thursday of Geneva Commons outdoor mall means more time with her son Chase.

Quality time. Not time crammed together in bumper-to-bumper traffic. No more grindingly slow trips to Fox Valley Center ...

...California Pizza Kitchen, Claddagh Irish Pub and Smokey Bones BBQ and Sports Bar have yet to set an opening date, said Anderson marketing manager Tracy Nemenz.

Fallon depicts Geneva Commons as a retail center for the serious shopper with sophisticated tastes.

"It is not a real teeny-bopper hangout like the mall," Fallon said. "It is an upscale shopping center where you go ...

...just awesome," said Genevan Beverly Block, whose excitement about the mall's opening motivated her to sidestep the construction cones and tour the site last week.

Much like the mall marketers, Block views Geneva Commons as the best of the best: a mix of commonly used stores and hard-to-find upscale shops; sit-down restaurants and front-door parking.

Geneva Commons uses aesthetics similar to Danada Square in Wheaton. Although laid out in the open air, the proximity parking style of strip malls, landscaping and clusters of shops diminish the common commercial look. Benches, fountains, and brick pavers along extra-wide sidewalks make it look a bit like a small-town shopping area.

And to top it off, there will be ...

...speakers. City officials and mall operators are negotiating what songs and how often the carillon will play, Fallon said.

The popular appliance store chain Best Buy will be taking over the remaining 30,000 square feet of the old HomePlace site in Indian River Commons, Indian River Mall/Commons officials announced last week.

"We're very excited about the lineup of new stores coming both at the mall and at the commons," Jamar said. "This list of new tenants will complement our existing shops."

Jamar said the tenants bring the occupancy at Indian River Mall to 89 percent and to 96 percent at Indian River Commons.
