In accordance with the authorization granted by Kim Landsman on August 31, 2004, the application has been AMENDED as indicated below. Please note that if the identification of goods or services has been amended below, any future amendments must be in accordance with 37 C.F.R. 2.71(a); TMEP section 1402.07(e). No response is necessary unless there is an objection to the amendment. If there is an objection to the amendment, the applicant should notify the examining attorney immediately. The Section 2(d) refusal in view of Registration No. 2,331,329 is withdrawn. Applicant’s translation of the mark has been entered. Applicant’s statement that the mark does not have any non-trademark significance in the industry is noted. The amendment to the identification of services is acceptable with the following amendment. After entry of the following amendment, the application will proceed to publication.
In the amended identification of services, the language “television programs in the nature of children’s games and entertainment” has been changed to “on-going television programs in the nature of children’s game shows and animated television cartoon series.”
