Dear Commissioner: The Office Action dated August 18, 2006, which issued in connection with the above-referenced application, has been received, and the following is in response thereto. REMARKS Applicant’s attorney wishes to thank the Trademark Attorney for the careful consideration given this case. Applicant has carefully reviewed the outstanding Office Action dated August 18, 2006, and, based upon the attached evidence file and following remarks, respectfully requests that the Trademark Attorney pass the subject application for registration of the mark on the Principal Register. Specimen The Trademark Attorney has objected to the specimen submitted with the Statement of Use stating that it is unacceptable because it is not clear whether the specimen shows the mark on the goods identified in the application. A digital photograph showing the entire furniture part on which the mark “STRONG ARM” is embossed is attached as an evidence file. This digital photograph is a complete version of the specimen submitted with the Statement of Use and thus does not constitute a “substitute specimen” requiring verification. Reconsideration and withdrawal of the refusal to register Applicant’s mark are thus respectfully requested. CONCLUSION Based on the foregoing, Applicant now believes it has completely responded to the outstanding Office Action dated August 18, 2006, and respectfully requests that the Trademark Attorney indicate the registrability of the mark on the Principal Register and pass the subject application for registration of the mark on the Principal Register.
