OFFICE SEARCH: The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d). TMEP section 704.02.

The following issues were discussed in communication with Brett Heavner on June 21, 2004.

The applicant’s disclaimer and prior registration have been accepted. However, the applicant’s amended identification of goods is still unacceptable as indefinite and describes goods in more than one class. The requirement that the applicant submit an acceptable identification of its goods is continued.

The wording “pastel sponges” and “containers for washing arts and crafts paint brushes” identifies goods in another class. The applicant may amend the wording “pastel sponges” to “paint applicator pastel sponges” this would remain in Class 16; Containers for washing arts and crafts paint brushes in International Class 21.

Should the applicant add the additional class the applicant must also submit an additional filing fee, this requirement is also continued.
