To the Commissioner for Trademarks:

The registrant requests the following amendment(s) to registration no. 3004743 MAYO(Standard Characters) has been amended as follows:

EXPLANATION OF FILING

Registrant wishes to amend the above registration by changing its corporate citizenship from “Minnesota Charitable Non-Profit Corporation” to “Minnesota Non-Profit Corporation” and requests that its registration be amended in accordance with Section 7(e) of the Lanham Act, 15 U.S.C. § 1057(e).

At the time of filing the original application, the Applicant was correctly listed as a “Minnesota Non-Profit Corporation.”  Subsequently, in submitting a Response to Office Action for the application, counsel for Applicant erroneously requested a change in corporate citizenship for the Applicant from “Minnesota Non-Profit Corporation” to “Minnesota Charitable Non-Profit Corporation.”  However, Registrant has been a “Minnesota Non-Profit Corporation” since its original business registration with the State of Minnesota on December 10, 1984.  A printout from the Minnesota Business and Lien System, Office of the Minnesota Secretary of State Business Record Details, listing the history of Registrant’s business filings, is attached as Exhibit A.

Registrant believes that the error was made in good faith and that it fits within the parameters of “correctable errors” as set forth in Section 1201.02(c) of the Trademark Manual of Examining Procedure.  Furthermore, the requested Amendment does not materially alter the character of the registration and republication of the mark would not be required.  Accordingly, Registrant requests that its entity designation be corrected in the records to “Minnesota Non-Profit Corporation.”  No Office errors are being alleged, nor is a new certificate being requested in the name of a new owner.
