NOTICE OF SUSPENSION

 

Action on this application is suspended pending receipt of a true copy, a photocopy, a certification, or a certified copy of a foreign registration from the applicant's country of origin.  If the registration is in a foreign language, an English translation must be submitted. The true copy, photocopy, certification, or certified copy of the registration should be forwarded to the Examining Attorney as soon as possible.  If the foreign application is abandoned, the Examining Attorney should be advised.

 

Applicant is advised that the informality concerning the identification of goods is maintained and continued for the following reason:

 

IDENTIFICATION OF GOODS -UNACCEPTABLE:

Applicant amended the identification of goods but it is still indefinite as written because the applicant uses the wording "devices and accessories."  Also, applicant amended the identification to include broader terms, which is not acceptable.   The identification of goods must be specific. The applicant must amend the identification to specify the common commercial name of the goods or to indicate their nature.  The identification must be all‑inclusive. The applicant should amend the identification to replace this wording with "namely." The applicant may amend the identification to substitute the following wording, if accurate:  “Surgical and medical apparatus and instruments, namely, therapeutic devices and accessories, namely, [must specify those devices and accessories]   used in minimally invasive vascular interventions,” in International Class 10.   37 C.F.R. Section 2.71(a); TMEP sections 1402.01 and 1402.03 et seq. [1]

 

 

Please note that, while the identification of goods and/or services may be amended to clarify or limit the goods and/or services, adding to the goods and/or services or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include goods and/or services that are not within the scope of the goods and/or services set forth in the present identification.
