The assigned trademark examining attorney has reviewed the referenced application filed on ^, and has determined the following.

 

The following authorities govern the processing of trademark and service mark applications:  The Trademark Act, 15 U.S.C. Section 1051 et seq., the Trademark Rules of Practice, 37 C.F.R. Part 2, and the Trademark Manual of Examining Procedure (TMEP).

 

Search Results

The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

Identification of Goods

The current wording used to describe the goods needs clarification because “May 28, 2003.” Applicant may adopt the following identification of goods, if accurate:

 

Ultrasonic cleaning equipment and associated cleaning equipment, namely, [the applicant musts specify the nature of the equipment by its common commercial name, e.g. multi purpose high pressure washers, vacuum cleaners] for cleaning automotive and industrial parts in Class 7.  TMEP §1402.01.

 

The applicant may wish to consult the on-line identification manual on the USPTO homepage for a searchable database of acceptable identifications for goods and services.  The manual is available at www.gov.uspto.report/web/offices/tac/doc/gsmanual.

 

Please note that, while the identification of goods may be amended to clarify or limit the goods, adding to the goods or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.

 

Disclaimers

Applicant must disclaim the descriptive wording “CLEAN” apart from the mark as shown because it merely describes a feature or purpose of the goods.  Trademark Act Section 6, 15 U.S.C. §1056; TMEP §§1213 and 1213.03(a).

 

The computerized printing format for the Office’s Trademark Official Gazette requires a standardized format for a disclaimer.  TMEP §1213.08(a)(i).  The following is the standard format used by the Office:

 

No claim is made to the exclusive right to use “CLEAN” apart from the mark as shown.
