The assigned examining attorney has reviewed the statement of use filed on July 17, 2006 and has determined the following.

 

SPECIMEN REFUSAL AS TO CLASS 41 ONLY

 

The specimen is unacceptable as evidence of actual service mark in Class 41 use because it does not demonstrate use of the mark in connection with the recited services.  TMEP §904.05.  The applicant must submit a specimen showing the mark as it is used in commerce.  37 C.F.R. §§2.56 and 2.88(b)(2).  Examples of acceptable specimens are signs, photographs, brochures or advertisements that show the mark used in the sale or advertising of the services.  TMEP §1301.04.  The applicant must verify, with an affidavit or a declaration under 37 C.F.R. §2.20, that the substitute specimen was in use in commerce prior to the expiration of the time allowed to the applicant for filing a statement of use.  37 C.F.R. §2.59(b); TMEP §904.09.

 

If an amendment of the dates‑of‑use clause is necessary in order to state the correct dates of first use, the applicant must verify the amendment with an affidavit or a declaration in accordance with 37 C.F.R. §2.20.  37 C.F.R. §2.71(c); TMEP §903.05.

 

The specimens of record make it clear that SILVER BULLET identifies an amusement park ride and not the actual amusement park.   Applicant should submit a specimen that demonstrates that SILVER BULLET identifies an amusement park and not a specific ride.

 

ALTERNATIVE SOLUTION

 

Alternatively, if applicant were to amend the recitation of services in Class 41 as follows, the examining attorney would withdraw this refusal:  “Entertainment services in the nature of an amusement park ride,” in Class 41. 

 

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, the applicant may not amend to include any services that are not within the scope of the services recited in the present identification.

 

SPECIMEN STATEMENT (IF REQUIRED)

 

The statement supporting use of the substitute specimen must read as follows: 

 

The substitute specimen was in use in commerce prior to the expiration of the time allowed to the applicant for filing a statement of use. 

 

The applicant must sign this statement either in affidavit form or with a declaration under 37 C.F.R. §2.20; TMEP §§904.09 and 1109.09(b). 

 

The following is a properly worded declaration under 37 C.F.R. §2.20.  At the end of the response, the applicant should insert the declaration signed by a person authorized to sign under 37 C.F.R. §2.33(a).
