The assigned examining attorney has reviewed the referenced application and determined the following:
The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d). TMEP section 1105.01.
The examining attorney refuses registration on the Principal Register because the mark is primarily merely a surname. Trademark Act Section 2(e)(3), 15 U.S.C. Section 1052(e)(3); TMEP section 1211. The examining attorney must consider the primary significance of the mark to the purchasing public to determine whether a term is primarily merely a surname. In re Kahan & Weisz Jewelry Mfg. Corp., 508 F.2d 831, 184 USPQ 421 (CCPA 1975). Please see the attached evidence from Lexis Nexis- U.S. Find, establishing the surname significance of the mark.
The attached evidence shows over 62 thousand listings for the surname “ARMSTRONG,” illustrating the primary significance of the name as a surname. The primary significance of the proposed mark in the mind of consumers, then, is as a surname. The mark, therefore, does not serve as a source identifier of the applicant's goods.
Registration of the proposed mark must be refused. The applicant may, however, offer evidence in support of registration, specifically, that the proposed mark has more than surname significance.
The Applicant may also overcome the refusal as stated below:
Acquired Distinctiveness/ Amendment to Section 2(f)
The applicant may seek registration under the Trademark Act Section 2(f), 15 U.S.C. §1052(f), by claiming acquired distinctiveness through ownership of previous U.S. Registration (s). To do so, the applicant must provide a statement that the mark has become distinctive of the goods/services as evidenced by ownership of U.S. Registration (s) No(s). on the Principal Register for the same mark for related goods or services. 37 C.F.R. §2.41(b); TMEP §§1212.04 et seq.
The applicant must also respond to the following informalities within six months from the date of this notice:
The applicant should claim ownership of U.S. Registration Nos. 1,686,011, 1,055,367, 2,227, 937 and others.
The identification of goods is unacceptable as indefinite. The applicant may adopt the following identification, if accurate: Kitchen cabinets and Bathroom, room vanity units, (in International Class 20). TMEP §1402.01.
Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.
The specimen is unacceptable as evidence of actual trademark use because it does not show use of the mark on the goods or labels or tags for the goods, but shows use in the advertising of the goods. Invoices, announcements, order forms, bills of lading, leaflets, brochures, publicity releases and other printed advertising material generally are not acceptable specimens. In re Bright of America, Inc., 205 USPQ 63 (TTAB 1979); TMEP §§904.05 and 904.07. See In re Ultraflight Inc., 221 USPQ 903 (TTAB 1984). The applicant must submit a specimen showing the mark as it is used in commerce. 37 C.F.R. §2.56. Examples of acceptable specimens are tags, labels, instruction manuals, containers, and photographs that show the mark on the goods or packaging. TMEP §§904.04 et seq. The applicant must verify, with an affidavit or a declaration under 37 C.F.R. §2.20, that the substitute specimen was in use in commerce at least as early as the filing date of the application. 37 C.F.R. §2.59(a); TMEP §904.09.
