This letter responds to the applicant’s communication filed on May 20, 204. The examining attorney acknowledges and accepts the applicant’s amended identification of goods, however, the amended drawing is unacceptable and the applicant has not amended the description of the mark. 

 

 

DRAWING PAGE

 

Applicant must submit a new drawing showing the entire mark clearly and conforming to 37 C.F.R. §2.52.  The current drawing is not acceptable because it is too light and it will not reproduce satisfactorily.  TMEP §807.07(a).  Additionally, The TM is not part of the mark, and the applicant should delete this from the drawing.  TMEP §§807.04 and 807.15.

 

 

DESCRIPTION OF THE MARK

 

Applicant must submit a concise description of the mark.  37 C.F.R. §2.37; TMEP §§808 et seq.  The following is suggested:

The mark consists of a car with a red body traversing an S-shaped road with the words “The Road of Life” beneath it.

 

 

COLOR CLAIMED AS A FEATURE OF THE MARK

 

Applicant must submit the following:  (1) a statement that “the color(s) red is claimed as a feature of the mark;” and (2) a separate description of where the colors appear in the mark, i.e., “the color red appears on the car.”  37 C.F.R. §2.52(b)(1).  Common color names should be used to describe the colors in the mark, e.g., red, yellow, blue.  Exam Guide 01-03, section I.B.1.
