RE:  Note of Replacement of:  2868719

The United States Patent and Trademark Office received your Note of Replacement of U.S. Registration No. 2868719 by Registered Extension of Protection No. 4650940 on April 24, 2017.

However, the request to note the replacement must be denied for the following reason(s):

U.S. Registration. No. 2868719 for which the request to note the replacement with U.S. registered extension of protection No. 4650940 was cancelled under Section 8 of the Trademark Act, 15 U.S.C. §1058, before the issuance of the U.S. registered extension of protection.  A request to note the replacement of a U.S. registration with a U.S. registered extension of protection must be based on a current U.S. registration.  Madrid Protocol, Article 4bis; 15 U.S.C. §1141n.

In view of the deficiencies identified above, the request to Note the Replacement cannot be accepted. Please see TMEP §1904.12 for further information about noting replacement of a U.S. national registration.
