The assigned examining attorney has reviewed the referenced application and determined the following.
Section 2(d) - Likelihood of Confusion Refusal
The examining attorney refuses registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d), because the applicant’s mark, when used on or in connection with the identified goods/services, so resembles the mark in U.S. Registration No. 1934733 as to be likely to cause confusion, to cause mistake, or to deceive. TMEP §§1207.01 et seq. See the enclosed registration.
The applicant seeks to register NORTH WIND for calamari. The registered mark is NORTHERN WIND OCEAN REQUESTS for prepared frozen seafood entrees. The registered mark is comprised of two prominent source identifiers: NORTHERN WIND (the registrant is Northern Wind, Inc.) and OCEAN REQUESTS. Without ignoring the latter wording, due regard must be given the wording NORTHERN WIND in comparison to the applicant’s mark NORTH WIND. These terms are very similar and likely to create confusion (even with the additional wording OCEAN REQUESTS) where the goods are also similar. Here, the goods are calamari and prepared frozen seafood entrees. While the goods are not identical, they are each “seafood.”
Although the examining attorney has refused registration, the applicant may respond to the refusal to register by submitting evidence and arguments in support of registration.
