The following issues were discussed in communication with Christy Baty Heinze on September 10, 2003.
Identification of Services
The recitation of services is unacceptable as indefinite because it is too broad. The applicant must amend the recitation to identify the computer services and the computer security services by their common commercial names, specifically identifying the type of computer security provided. TMEP §1402.11. For example, the applicant may adopt the following wording if accurate: computer services, namely, monitoring of computer systems for computer security purposes and providing online information regarding computer security.
Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, the applicant may not amend to include any services that are not within the scope of the services recited in the present identification.
