This letter responds to the applicant’s communication filed on March 26, 2004, under a certificate of mailing.

 

Mark Primarily Merely a Surname

Registration was refused under Trademark Act Section 2(e)(4), 15 U.S.C. Section 1052(e)(4), because the mark for which registration is sought is primarily merely a surname.  The examining attorney has considered the applicant's arguments carefully but has found them unpersuasive.  For the reasons below, the refusal under Section 2(e)(4) is maintained and made FINAL.

 

The applicant applied to register the mark DEVINO in typed form for “vehicle wheels”.  In its response, applicant argues that the mark is not primarily merely a surname because the term DEVINO is a rare surname and is a variation of DIVINO, the Italian word for “heavenly” or “divine”.  The examining attorney respectfully disagrees.

 

Although the term DEVINO appears to be a relatively rare surname, a rare surname may be unregistrable under Trademark Act §2(e)(4), 15 U.S.C. §1052(e)(4), if its primary significance to purchasers is that of a surname.  See In re Etablissements Darty et Fils, 759 F.2d 15, 225 USPQ 652 (Fed. Cir. 1985) (DARTY); In re Rebo High Definition Studio Inc., 15 USPQ2d 1314 (TTAB 1990) (REBO); TMEP §1211.01(a)(v).  There is no minimum number of telephone directory listings needed to prove that a mark is primarily merely a surname.  TMEP §1211.02(b)(i).  Thus, regardless of the rarity of the surname, the test is whether the primary significance of the term to the purchasing public is that of a surname.

 

Applicant asserts that “DEVINO is a slight misspelling of DIVINO which means heavenly or divine in Italian”.  Applicant’s Response Filed March 26, 2004, at 2 (hereinafter “Response”).  However, this assertion is immaterial to the inquiry of whether DEVINO is primarily merely a surname since the translation relates to DIVINO rather than DEVINO.  Indeed, applicant has failed to submit any evidence to demonstrate that DEVINO is anything but a surname.

 

In further support of the examining attorney’s finding that DEVINO is a surname, the examining attorney attaches excerpts from numerous news articles from the LEXIS/NEXIS® database in which DEVINO appears primarily as a surname.  See attachments. 

 

Since it is clear from the attached evidence that DEVINO will be perceived primarily as a surname, the refusal under Section 2(e)(4) of the Trademark Act is maintained and made FINAL.

 

Options

If applicant fails to respond to this final action within six months of the mailing date, the application will be abandoned.  15 U.S.C. §1062(b); 37 C.F.R. §2.65(a).  Applicant may respond to this final action by: 

 

(1)   submitting a response that fully satisfies all outstanding requirements, if feasible (37 C.F.R. §2.64(a)); or

(2)   filing an appeal to the Trademark Trial and Appeal Board, with an appeal fee of $100 per class (37 C.F.R. §§2.6(a)(18) and 2.64(a); TMEP §§715.01 and 1501 et seq.; TBMP Chapter 1200).
