The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.
Identification of Goods
The identification of goods in international class 5 is unacceptable as indefinite because the diseases or conditions to be treated by the goods must be set forth (e.g., pharmaceutical preparations for use in the treatment of cardiac disorders, diabetes, cancer, liver disease, glaucoma) of the general class of pharmaceutical preparations must be set forth (e.g., antihypertensives, antibiotics, analgesics – see on-line manual for complete list of these). Applicant must amend the identification accordingly. TMEP §1402.01.
