This letter responds to the applicant’s communication filed on June 18, 2004.
Applicant’s amended identification of good is accepted. The refusal under Section 2(d) is maintained, however, because applicant’s goods, guitar picks, and registrant’s goods, drumsticks and related drum accessories, are the types of goods which frequently emanate from a common source and therefore are in each other’s normal fields of expansion. See the enclosed representative sample of third-party registrations whose identifications of goods include both applicant’s and registrant’s goods.
In addition, the specimen does not show use of the mark for any goods identified in the application. The applicant must submit a specimen showing use of the mark for the goods specified. 37 C.F.R. §2.56; TMEP §904. The applicant must verify, with an affidavit or a declaration under 37 C.F.R. §2.20, that the substitute specimen was in use in commerce at least as early as the filing date of the application. 37 C.F.R. §2.59(a); TMEP §904.09. In particular, the specimen of use shows applicant’s mark used in connection with drumsticks rather than with guitar picks. Applicant must submit a specimen of use showing the mark used in connection with the goods at issue.
The applicant must verify, with an affidavit or a declaration under 37 C.F.R. §2.20, that the substitute specimen was in use in commerce at least as early as the filing date of the application. 37 C.F.R. §2.59(a); TMEP §904.09.
The following is a properly worded declaration under 37 C.F.R. §2.20. At the end of the response, the applicant should insert the declaration signed by a person authorized to sign under 37 C.F.R. §2.33(a).
