This letter responds to the applicant’s communication filed on November 10, 2003.  Please note that all issues not discussed in this office action have been resolved.

 

Suspension of Application – Serial No. 76-437249

 

Pending the disposition of Application Serial No. 76-437249, action on this application is SUSPENDED.  The applicant’s explanation of the goods in this prior pending application is noted.  However, a likelihood of confusion determination must be made based on the goods as they are identified in the application.  Here, the electrical connectors of the prior pending applicant are worded broadly enough to include connectors of the same type as those connectors included in the applicant’s goods and the electrical connectors are related to and likely to be used in conjunction with the other goods comprising the applicant’s electrical intracommunication systems.

 

Withdrawal of the Likelihood of Confusion Refusal – Registration No. 2,670,814

 

The examining attorney has considered the applicant’s arguments and amended identification of goods carefully and the refusal under Section 2(d) of the Trademark Act pertaining Registration No. 2,670,814 is hereby WITHDRAWN.

 

Withdrawal of the Potential Likelihood of Confusion Refusal – Serial No. 78-065384

 

The examining attorney has considered the applicant’s arguments and amended identification of goods carefully and the potential refusal under Section 2(d) of the Trademark Act pertaining Serial No. 78-065384 is hereby WITHDRAWN.

 

Filing Fee Advisory - Fee Increase Effective January 1, 2003

Effective January 1, 2003, the fee for filing an application for trademark registration will be increased to $335.00 per International Class.  The USPTO will not accord a filing date to applications that are filed on or after that date that are not accompanied by a minimum of $335.00. 

 

Additionally, the fee for amending an existing application to add an additional class or classes of goods/services will be $335.00 per class for classes added on or after January 1, 2003.
