Dear Sir or Madam:

The examining attorney has determined that the applicant has classified the identified goods incorrectly.  The applicant has classified the goods in Class 3, namely “nail-care kits” containing products that themselves otherwise belong either in Class 3 or 8.  The examiner believes that the goods should be split into Class 3 and Class 8.

The applicant respectfully requests that the examiner reconsider its decision and cites, for example, the description of goods for the YES registration, 2,715,831, in support of its position.  The goods identified for that registration include, among other things:

Acrylic fingernail sculpturing kits containing acrylic powders in various colors, acrylic liquid, primers, artificial nail forms, adhesive, nail files, acrylic sculpting brush, sanding block and dish to hold acrylic components.

That registration is a single-class registration, Class 3.

                        In sum, the applicant requests that the examiner reconsider its improper-classification determination.

                        Finally, the applicant hereby indicates that it is a Netherlands corporation.
