This letter responds to the applicant's communication filed on March 25, 2004, in which the applicant (1) amended the identification of goods; (2) added a class; (3) submitted new specimens of use and (4) argued against the potential refusal to register the mark under Section 2(d) of the Trademark Act. Numbers 1, 2 and 3 are accepted.
The examining attorney has searched the Office records and has found no similar registered mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d). TMEP section 704.02.
