RESPONSE TO OFFICE ACTION
This paper responds to the outstanding Office Action mailed on September 16,
2003. Applicant respectfully solicits allowance of this response in view of
the following remarks.
AMENDMENT
Per the examining attorney's request, Applicant requests the following
amendment be inserted into the application:
No claim is made to the exclusive right to use GREEN apart
from the mark as shown.
DISCUSSION
The examining attorney requires that the applicant disclaim the term "GREEN"
apart from the mark as shown. While the applicant is not in agreement that
the term GREEN merely describes a feature of the services, it hereby inserts
the disclaimer, according to the above Amendment section, in the interest of
expediting the application toward publication and registration on the
Principal Register.
FEE
No fee is believed to be necessary. However, in the event a fee is required,
the Commissioner is authorized to charge our Deposit Account No. 06-0029 and
notify us of the same.
CONCLUSION
Applicant respectfully requests that, with this Amendment and Response, the
Examining Attorney approve the application for publication on the Principal
Register.
