The assigned examining attorney has reviewed the application and determined the following.
• Search of Office records.
The examining attorney has searched the Office records and has found no similar registered or pending mark which bars registration under Trademark Act §2(d), 15 U.S.C. §1052(d). TMEP §704.02.
However, the applicant must respond to the following.
1. Identification (and classification) of goods/services.
In the identification, the applicant must use the common commercial names for the goods, be as complete and specific as possible, and avoid the use of indefinite words and phrases. If the applicant chooses to use indefinite words––such as “accessories,” “apparatus,” “components,” “devices,” “equipment,” “instruments,” “materials,” “parts,” “products,” or “systems”––then those words must be followed by the word “namely” and the items listed by their common commercial names or by describing the nature and intended use of the items. TMEP §§1402.01 and 1402.03.
Also, the applicant must list its goods exhaustively, not illustratively.
The identification of goods/services is unacceptable as indefinite or overbroad. TMEP §1402.01. The applicant may adopt the following identification (and classification), if accurate:
Class 3––beauty products includingin the nature of hair accessories, such asnamely
clips,[Class 26] pony-tail holders,[Class 26] hair preparations being hair-sticks styling gel; grooming devices,
such as brushes,[Class 21] brushes with applicators for applying hair products;[Class 21]and hair productspreparations for cleaning, conditioning,
and styling
Class 26––beauty products in the nature of hair accessories, namely hair clips, pony-tail holders, and collapsible hair sticks used for styling and fastening hair in place
Class 21––grooming devices, such asnamely brushes, brushes with applicators for applying hair products
This Office’s Acceptable Identification of Goods & Services Manual is accessible at http://www.gov.uspto.report/web/offices/tac/doc/gsmanual/manual.html (searchable using Ctrl+F). The applicant should also note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, the applicant may not amend to include any goods/services that are not within the scope of the goods/services set forth in the present identification.
2. Fee.
If the applicant prosecutes this application as a multiple- (rather than as a single-) class application, the applicant must comply with each of the following:
(a) The applicant must specifically identify the goods/services in each class and list the goods/services by international class in ascending numerical order. TMEP §1403.01.
(b) The applicant must submit a filing fee for each international class of goods/services not covered by the fee already paid. 37 C.F.R. §§2.6(a)(1) and 2.86(b); TMEP §§810.01 and 1403.01. Effective January 1, 2003, the fee for filing a trademark application is $335 for each class. This applies to classes added to pending applications as well as to new applications filed on or after that date.
3. Disclaimer.
The applicant must, as shown below, disclaim the descriptive wording “locks” apart from the mark. Trademark Act § 6, 15 U.S.C. §1056; TMEP §§1213 and 1213.03(a). The wording is merely descriptive because it merely describes an ingredient, quality, characteristic, function, feature, purpose, or use of the applicant’s hair-related goods; see Appendix hereto.
The computerized printing format for the Official Gazette requires a standard form for a disclaimer. TMEP §1213.08(a)(i). A properly worded disclaimer should read as follows:
No claim is made to the exclusive right to use “locks” apart from the mark as shown.
