This letter responds to the applicant’s communication filed on August 6, 2004 in which the applicant amended the identification of goods and services. The amended identification is acceptable and has been entered in the record.
Despite the applicant’s amended identification of goods, the potential for likelihood of confusion under Trademark Act Section 2(d) still exists because the parties’ goods are closely related and the marks are highly similar. As a result, the citations of prior pending Application Serial Nos. 76144629 (now registered as U.S. Registration No. 2802790), 76332096 (now registered as U.S. Registration 2741112), 78033307 (now registered as U.S. Registration No. 2795976) and 78048498 for potential likelihood of confusion under Trademark Act Section 2(d) are CONTINUED.
