This letter responds to the applicant’s communication filed on October 13, 2003.

 

The amendments to identification of goods are noted. However, the proposed amendment of the identification is unacceptable because the wording “ woofers, tweeters, amplifiers, capacitors, enclosures for speakers and like components, DVD players, CD players, audio receivers, AM/FM tuners, DVD changers, CD changers, cable connectors, signal processors, audio sound equalizers, remote control devices controlling sound, volume, direction of sound, bass, and treble, electrical and power cables, adaptor changing voltage, digital volt meters, distribution blocks to distribute power to components, fuse distribution blocks to prevent systems from losing power, line drivers to boost the signal, phase shifters to delay the signal, electronic crossovers to change the frequency of sound, bass drivers to boost the signal at low frequencies, electrical wires, grills, amplifier installation kits, radios, “ designates goods that are not within the scope of the identification that was set forth in the application at the time of filing.  While an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. §2.71(a); TMEP §§1402.06 et seq. and 1402.07.

 

 

 

 

The identification of goods should read:

 

         Mobile audio components, namely speakers and speaker grills.

 

The applicant must rewrite the identification of goods in its entirety because of the nature and extent of the amendment.  37 C.F.R. §2.74(b).

 

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.
