OFFICE SEARCH:  The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d).  TMEP section 704.02.

RECITATION OF SERVICES

 

The recitation of services is unacceptable as indefinite.  The applicant may adopt the following recitation, if accurate: 

 

International Class 41:            Educational services, namely, conducting [indicate specific mode of instructions, e.g. classes, seminars, conferences, workshops] in the field of [indicate specific field, e.g. pet care, math, tax preparation]; providing of training services in the field of [indicate field or subject matter]; entertainment in the nature of [indicate specific event or act, and field, e.g. live musical group, television comedy series, ethnic festival]; arranging and conducting of colloquiums, conferences, congresses, seminars, symposiums and workshops in the field of [indicate specific field, e.g. pet care, math, tax preparation]; entertainment in the nature of competitions in the field of [indicate field, e.g. athletics, spelling]; conducting entertainment exhibitions in the nature of [indicate specific event, e.g. magic show, wine festivals] and providing information, advice and consultation relating therto.  TMEP §1402.11.

 

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, the applicant may not amend to include any services that are not within the scope of the services recited in the present identification.
