FINAL OFFICE ACTION

This letter responds to the applicant’s communication filed on July 29, 2003 in which the applicant 1) amended the identification of goods; 2) addressed the significance of the mark; and 3) submitted addition information.  Items 2 and 3 are acceptable.  The applicant must note the following.

Identification of Goods - Indefinite

The identification of goods as amended is unacceptable as indefinite because of the language “and the following accessories, namely belt clips, neck cord, chains, and carrying cases for the aforementioned goods”.  Also, applicant must remove any parentheses from the identification of goods and/or services and incorporate the parenthetical information into the description.  Generally, parentheses and brackets should not be used in identifications.  Parenthetical information is only permitted in identifications if it serves to explain or translate the matter immediately preceding the parenthetical phrase in such a way that it does not affect the clarity of the identification, e.g., “obi (Japanese sash).”  TMEP §1402.12.

 

The applicant may adopt the following, if accurate and must amend the identification.

 

Portable, voice activated, two-way family radio service communicator and general mobile radio service communicator that incorporates a clock and accessories, namely a belt clip, neck cord, chains, and carrying cases for the aforementioned goods, sold as a unit, in International Class 9.

This requirement is continued and made FINAL.

Please note that the only appropriate responses to a final action are (1) compliance with the outstanding requirements, if feasible, (2) filing of an appeal to the Trademark Trial and Appeal Board, or (3) filing of a petition to the Director if permitted by 37 C.F.R. §2.63(b). 37 C.F.R. §2.64(a); TMEP §715.01.  Regarding petitions to the Director, see 37 C.F.R. §2.146; TMEP Chapter 1700 regarding petitions.  If the applicant fails to respond within six months of the mailing date of this refusal, this Office will declare the application abandoned.  37 C.F.R. §2.65(a).
