The Applicant submits the present response in reply to the Notice of Suspension issued by the Office on March 9, 2005. In the Notice of Suspension, the Office indicated that action on the application was suspended pending receipt of a true copy, a photocopy, a certification, or a certified copy of the Certificate of Registration in the country of origin of the Applicant.
However, it is noted that Applicant previously submitted a certified copy and an English translation of the registration certificate directed to the present mark, SUMAX, in Applicant's country of origin, the Republic of Korea in a communication mailed on August 26, 2004 with a proper Certificate of Mailing. The Office's receipt of the foreign registration certificate is recorded on the Trademark Electronic Search System. Furthermore, in the Office Action dated February 1, 2005, the Office acknowledged receipt of the foreign registration indicating that Applicant's goods identification must be amended to correspond to that of the foreign registration, which Applicant did in the Response of February 8, 2005. Therefore, the Applicant submits that the Office's requirement for the foreign registration is unwarranted.
The Applicant respectfully submits that the application is in condition for allowance in all respects. The Applicant believes that it has fully responded to all outstanding issues in this matter. However, if, after consideration of the present response, there remain any open issues that possibly can be resolved by a telephone interview, then Applicant's undersigned attorney most respectfully requests that he be called to discuss and attempt to resolve those issues.
