This letter responds to Applicant’s communication filed on 11-30-05.  Applicant responded by amending the recitation of services and submitting a copy of the foreign registration.  The assigned examining attorney has reviewed Applicant’s response and determined the following.  Applicant's copy of the foreign registration is accepted and has been entered into the record.  However, Applicant's recitation of services remains unacceptable.  Therefore, the following requirements are herein made FINAL.

 

Recitation of Services

Applicant must clarify the identification of services to better specify the nature of the services as well as their main purpose and their particular field of use or channels of trade if possible. Please note that the recitation of services for classes, 36, 41, 42, 43 and 44 are acceptable.

 

Please note the following guidelines when amending the identification of goods:

 

· Registered marks are not to be used in the application to describe applicant's goods/services.  TMEP §1402.09.

 

· Parenthetical information is only permitted in identifications if it serves to explain or translate the matter immediately preceding the parenthetical phrase in such a way that it does not affect the clarity of the identification, e.g., “obi (Japanese sash).”  TMEP §1402.12.

 

· While the identification of goods and/or services may be amended to clarify or limit the goods and/or services, adding to the goods and/or services or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include goods and/or services that are not within the scope of the goods and/or services set forth in the present identification.

Please note that the only appropriate responses to a final action are either (1) compliance with the outstanding requirements, if feasible, or (2) filing of an appeal to the Trademark Trial and Appeal Board.  37 C.F.R.
