Response to Office Action for Post-Registration Matters

To the Commissioner for Trademarks:

The following is submitted for registration number. 2836042 HULK :

FORM INFORMATION

Registrant hereby submits a response to the post registration office action issued on April 29, 2014.  The Trademark Specialist requests clarification regarding the subject registration’s chain of title.  Registrant notes that the application was filed in the name of United Dominion Industries, Inc., on November 13, 2002.  After the filing of the application, the following changes in ownership occurred:

1.      United Dominion Industries, Inc. merged with SPX Corporation on December 20, 2003. Documents evidencing this merger was recorded with the USPTO under reel/frame no. 2923/0278;

2.      SPX Corporation assigned the mark to Kelly Company, Inc.  This assignment was effective as of December 30, 2003 and was recorded with the United States Patent and Trademark Office under reel/frame no. 5385/0846[1];

3.      Kelly Company, Inc. changed its name to SPX Dock Products, Inc.  This name change was effective on January 21, 2004 and was recorded with the United States Patent and Trademark Office under reel/frame no. 2948/0275; and

4.      SPX Dock Products, Inc. changed its name to 4Front Engineered Solutions, Inc. This name change was effective October 20, 2006 and was recorded with the United States Patent and Trademark Office under reel/frame no. 5301/0996.

In consideration of the above, Registrant submits that there is no longer a gap in the chain of title for the present registration, and all outstanding requirements raised in the post registration office action have been addressed.  Therefore, Registrant respectfully requests that the Notice of Acceptance/Renewal be issued in the name of 4Front Engineered Solutions, Inc.  However, if further clarification is needed or if a telephone conference would be useful in resolving any issues pending in this registration, Registrant requests that the Trademark Specialist contact the undersigned.
