EXPLANATION OF FILING

On December 6, 2006, the above-identified service mark was registered on the Principal Register.  Upon a recent review of our files, registrant’s attorney noticed that the Certificate of Registration did not include the color claim which was set forth in the application in the description of the mark as follows:  "The drawing consists of the word AFFYMAX in the dark blue PANTONE color 280C, The triangular shape in the drawing consists of the light blue PANTONE color Hexachrome Cyan C; The swoosh design on the left side of the triangular shape in the drawing consists of the dark blue PANTONE color 280C."  Registrant’s attorney respectfully requests that the PTO issue a new, amended Certificate of Registration that shows the claim of color.
