This e-mail is being sent to confirm our conversation this morning.
Currently, the TARR web server states that, "An office action making FINAL a
refusal to register the mark has been mailed."
As you might guess, I'm a bit antsy about seeing "FINAL" and "refusal" in
the same sentence concerning our mark.
As we discussed this morning, we've sent you an amendment to our application
fixing those two errors that you had instructed required correction, namely:
1.) the use of brackets in identification of goods, and 2.) the use of some
gray-scale in the mark itself.
*** As a side note, I see that the changes we made to the description of
goods are already reflected on the TARR web site, and the mark that we
originally sent has been scanned in (you'd mentioned that part of the
problem was the old scanners, and that new equipment is now in use). I
assume that, these changes having been made, our application will now
progress forward.
You indicated this morning that if our corrections are acceptable, the
application's approval process would continue forward once more. I am
simply following up to ensure that I have a clear understanding of our
conversation. If there is anything else that I need to do in order to see
that this trademark continues through the registration process, please write
to me at your earliest convenience concerning the same.
As I mentioned, this mark is part of the sale of a company, which includes
intellectual property rights. As such, I need to ensure that this
application is completed as soon as possible.
