The following issues were discussed in communication with Kevin McCarthy on March 20, 2003.
Applicant will respond to the requirement to furnish statements that the lining on the drawing is a feature of the mark and that stippling on the drawing indicates shading.
If applicant selects the use (Section 1A) basis for the application, he is required to furnish an example of mark use, such as advertising. Use of the specimen before the application filing date of October 28, 2002 must be supported either by a TMR 2.20 declaration (the paragraph just above the signature line of the application) or a notarized statement.
Applicant will respond to requirement for a disclaimer of the descriptive wording “bass TV”.
