The assigned examining attorney has reviewed the referenced application and determined the following.
Search Results
The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.
Section 2(e)(1) - Descriptive Refusal
The examining attorney refuses registration on the Principal Register because the proposed mark merely describes the goods which applicant’s goods are intended for. Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1); TMEP §§1209 et seq.
DIGITAL is descriptive for digital cameras, which are the goods that applicant’s bags are intended for. GEAR is a generic term for bags.
If the applicant chooses to respond to the refusal to register, the applicant must also respond to the following issues.
Classification
The applicant has classified the goods incorrectly. The applicant must amend the application to classify the goods in International Class 9. 37 C.F.R. §§2.32(a)(7) and 2.85; TMEP §§1401.02(a) and 1401.03(b).
Applicant may wish to delete the wording “APS TM cameras” from the identification of goods. APS is the subject of a pending trademark application for cameras. The applicant may not use registered marks in the identification of goods. TMEP §1402.09.
