Response to Office Action for Post-Registration Matters

To the Commissioner for Trademarks:

The following is submitted for registration number. 2920335 OUTKAST :

FORM INFORMATION

This Reply responds to the Office Action issued September 5, 2015, in connection with U.S. REGISTRATION NO. 2920335.

 

The Combined Section 8 Affidavit & Section 9 Renewal Application was filed on July 24, 2015.  It was indicated in the Office Action that the Section 9 portion of the combined filing can be granted.  However, it was indicated that the Section 8 portion was not accepted due to a break in the chain of title.

 

Chain of Title

 

The originally filed assignment listed the assignee on the cover sheet as “WGP, LLC C/O JOHN D. FLYNN C/O BRASS EAGLE, LLC.” The recorded document, attached as Exhibit A, lists the assignee as “WGP, LLC.” (Recorded at Reel/Frame #2854/0310).

 

WGP, LLC merged into “JT SPORTS LLC.” A copy of that merger is attached as Exhibit B. (Recorded at Reel/Frame #5636/0484).

 

“JT SPORTS LLC” assigned all right, title and interest in the mark and subject registration to “KEE ACTION SPORTS LLC,” as shown by Exhibit C. (Recorded at Reel/Frame #4198/0447).

 

The Combined Section 8 Affidavit & Section 9 Renewal Application filed on July 24, 2015 was filed on behalf of KEE Action Sports, LLC, as current owner of the mark.

 

As any chain-of-title issues are resolved, Registrant respectfully requests acceptance of the Combined Section 8 Affidavit & Section 9 Renewal Application previously submitted.

 

The undersigned remains available to discuss this matter if necessary at the Examining Attorney’s convenience.
