The assigned examining attorney has reviewed the referenced application and determined the following.

 

The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

Informalities

 

Before this application can proceed in the registration process, the following informalities must be addressed.

 

A.  Significance

 

The applicant must indicate whether the letters “MIAS” have any significance in the relevant trade or industry or as applied to the goods/services.  37 C.F.R. §2.61(b).  In other words, is the acronym “MIAS” in current use in the medical industry by other than applicant to indicate a type of surgery and if so, what type of surgery?  Moreover, would the initials “MIS” be recognized as an abbreviation for “minimally invasive surgery” and is it common practice to indicate the particular nature of the surgery by adding a letter after “mi” and before “s”?

 

B.  Recitation of Services

 

The registered term BOTOX® must be deleted from the recitation of services.

 

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, the applicant may not amend to include any services that are not within the scope of the services recited in the present identification.
