The Sections 8 & 15 Combined Affidavit, filed on March 31, 2010, has been reviewed and is acceptable. However, the party who filed the Combined Affidavit has requested that the United States Patent and Trademark Office (USPTO) issue a notice of acceptance and acknowledgement in their name INTERTEK USA, INC., rather than the name of the current owner of record APTECH ENGINEERING SERVICES, INC. Sufficient evidence has been provided to show chain of title to the new owner, however, such evidence has not been recorded with the Assignment Division.
The notice of acceptance and acknowledgement for the Combined Affidavit will issue in the name of the owner of record unless (1) ownership documents are recorded with the Assignment Division before expiration of the time to file a response to this Office action, and (2) the undersigned has been timely notified of said recordal within the response time period. 37 C.F.R. §3.85; TMEP §502.02.
To expedite recordation of ownership documents, the owner is encouraged to file requests for recordation through the Electronic Trademark Assignment System (ETAS) at http://etas.uspto.gov. There is a fee for recording ownership documents.
A proper response must be received, or recordation of the assignment completed, on or before 6 months from the issuance date of this Office action. If no response to this Office action is received within the response time period, the Combined Affidavit will be accepted and the notice of acceptance and acknowledgement will issue in the name of the owner of record.
