Applicant is requesting reconsideration of a final refusal dated October 9, 2003.
After careful consideration of the law and facts of the case, the examining attorney must deny the request for reconsideration and adhere to the final action as written since no new facts or reasons have been presented that are significant and compelling with regard to the point at issue. In particular, the applicant has failed to make required changes regarding whether the goods are manually or power-operated goods and failed to further specify the common commercial name or major component parts of other goods. The applicant should note that the mere classification of the goods in a particular international class does not satisfy the requirement to specify whether the goods are power-operated or manually-operated goods.
Accordingly, applicant’s request for reconsideration is denied. The time for appeal runs from the date the final action was mailed; therefore, the deadline was April 9, 2004. 37 C.F.R. Section 2.64(b); TMEP Section 715.03(c).
