In accordance with the authorization granted by Carol Wilhelm on September 10, 2003, the application has been AMENDED as indicated below. Please note that if the identification of goods or services has been amended below, any future amendments must be in accordance with 37 C.F.R. 2.71(a); TMEP section 1402.07(e). No response is necessary unless there is an objection to the amendment. If there is an objection to the amendment, the applicant should notify the examining attorney immediately.
The applicant has indicated that it wishes to proceed solely under Section 44. Accordingly, the Section 1(b) basis will be deleted from the application.
In addition, the applicant has submitted a photocopy of the foreign registration with the English translation. These submissions are acceptable and will be made of record to support the Section 44 basis.
The following items listed in the Class 39 portion of the description of services are further clarified and/or reclassified:
(1) The first part of the Class 39 description is amended to clarify the modes of transportation, and will be reformatted to read as follows:
Storage, warehousing and handling of goods; transportation of goods by truck, rail and air
(2) The next item in Class 39 – “vehicle inspection” – is deleted from this class, with vehicle inspection services being properly classified in International Class 42. Moreover, because the applicant has listed “motor vehicle inspection” as the very last item listed in Class 42, that wording is amended to delete the term “motor” so that it corresponds to the broader “vehicle inspection” wording that has been transferred from Class 39.
(3) Finally, the last item in Class 39 – “container inspection” – is amended and reclassified to the following:
Inspection of land, sea and air shipping containers, in Class 42
