This letter responds to the applicant’s communication filed on March 27, 2003.

 

The amended recitation of goods for Class 3 contains the indefinite wording “and other substances for laundry use”.  What do these “other substances” include?  Might one of the substances include “laundry sanitizer tablets” (which are in Class 5)?  From the wording used, one cannot determine.  If the goods identified by the indefinite wording do fall into more than one class, a combined application must be filed for the goods.  At minimum, the indefinite wording must be renamed by using the common specific names of those goods.

 

Applicant indicates that this application is based upon a trademark application filed in Europe.  If the prior filed application was filed in the European Community, the claim must be amended to so indicate.

 

 

 

 

 

 

 

If the applicant is the owner of Registration No. 1,291,666, the applicant must submit a claim of ownership.  37 C.F.R. §2.36; TMEP §812.
