The request for extension of time to file a statement of use (extension request) filed on November 7, 2005, will not be reviewed because an insurance extension request was submitted previously with or after the filing of a statement of use on May 10, 2005. 

 

An applicant may file an extension request with a statement of use, or after filing the statement of use if there is time remaining in the statutory time period for filing the statement of use, provided the granting the extension request would not extend the time for filing the statement of use more than 36 months after the issuance of the notice of allowance.  Such an extension request is called an “insurance” extension request.  Only one insurance extension request is permitted.  37 C.F.R. §2.89(e)(1); TMEP §1108.03.

 

FEE UNPAID:  The check submitted for the extension request filing fee was returned to the Office unpaid and thus the filing fee requirement has not been satisfied.  The filing fee is $150 per class and is one of the minimum filing requirements for an extension request.  15 U.S.C. §1051(d)(2); 37 C.F.R. §§2.6(a)(4) and (b)(12), and 2.89(a)(2) and (b)(2); TMEP §§405.06 and 1108.02(c).  There is an additional $50 processing fee for a returned check.  37 C.F.R. §2.6(b)(12).
