This letter responds to the applicant’s communication filed on July 17, 2003. The applicant provided an amended identification of goods and the foreign registration. The foreign registration is accepted and , as per the applicant's request, the Section 1(b) basis is deleted. Te following is advise:
The identification of goods is indefinite because the applicant uses the wording “etc.” in Class 9. The identification of goods must be specific. The applicant must specify the goods or delete the term. The applicant may amend to list only items that are within the scope of goods set forth in the identification. 37 C.F.R. §2.71(a); TMEP §§1402.01 and 1402.03(a).
The applicant may adopt the following identification in Class 9, if accurate: TMEP §1402.01.
Apparatuses and instruments for the storage of machine and system data, as well as specific process technology data of cocoa and chocolate products manufacture, control and adjustment of machines and systems, namely computer and control panels, software, monitoring means, and memories; apparatus and instruments for weak-current engineering and control engineering components of machines and systems, namely switches, panels, power packs, and control circuits for machines for processing cocoa and chocolate; apparatuses and systems for process monitoring, process control by intelligent software technologies, namely computers and software for milling, mixing and conching apparatuses
