The assigned examining attorney has reviewed the referenced application and determined the following.

 

The examining attorney has searched the Office records and has found no similar registered mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d).  TMEP section 1105.01.

 

Pending Applications

The examining attorney encloses information regarding pending Application Serial No. 76417578.  The filing date of the referenced application precedes the applicant's filing date.  There may be a likelihood of confusion between the two marks under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d).  If the referenced application matures into a registration, the examining attorney may refuse registration in this case under Section 2(d).  37 C.F.R. Section 2.83; TMEP, 2nd. Edition,, 2nd. Edition, section 1208.01.

 

Identification of Goods

The identification of goods is unacceptable as indefinite. The applicant may adopt the following identification of goods, if accurate. To the extent the suggested identification of goods or services is incomplete or inaccurate, the applicant is advised that the Trademark Acceptable Identification of Goods and Services Manual is accessible via the USPTO homepage at the following address: http://www.gov.uspto.report/web/offices/tac/doc/gsmanual/

 

Please also note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. Section 2.71(a); TMEP, 2nd. Edition, section 804.09.  Therefore, the applicant may not amend to include any goods or services that are not within the scope of the goods and services recited in the present identification.

 

International Class 11: FLASHLIGHTS AND LIGHTING DEVICES, NAMELY, (Applicant must name the specific lighting devices or delete this wording from the identification of goods.)

 

Use of Federal Registration Symbol

The specimen shows use of the federal registration symbol with the mark; however, Office records do not show that the mark is registered.  The applicant may not use the federal registration symbol until a mark is registered in this Office.  After registration of the mark, the applicant may use the symbol only with the specific goods or services recited in the registration. TMEP §§906 and 906.02.
