The applicant’s response to the first Office action was filed on June16, 2003. The examining attorney has reviewed the applicant’s amendments and arguments in favor of registration.  The amended identification of goods and substitute specimens of use have been accepted and entered into the record.  The applicant is respectfully advised, should it send in any future correspondence  in connection with this application, that the correct law office for the examining attorney is Law Office 108; not Law Office 111 as listed in the response to the first Office action and on the declaration in support of substitute specimens.  As to the other outstanding issues, the examining attorney has determined as follows.

 

PRIMARILY MERELY A SURNAME REFUSAL MAINTAINED AND MADE FINAL

 

Registration was refused on the principal register under Trademark Act Section 2(e)(4), 15 U.S.C. Section 1052(e)(4), because the mark for which registration is sought is primarily merely a surname. The applicant’s proposed mark is “SAIKO” for “clothing , namely belts, boots, braces, caps, coats, garters, gloves, hats, jackets, jerseys, jumpers, knitwear, namely knit shirts and pants, scarves, overalls, overcoats, pajamas, pants, pullovers, sandals, shirts, shoes, sock suspenders, socks, sports jerseys, athletic shoes, sportswear, namely polo shirts, athletic jerseys, stockings, suspenders, sweaters, underclothing, underpants, uniforms, footwear and headgear, namely, headwear, hats, caps.  The applicant has argued that its proposed mark is not primarily merely a surname because (1) evidence from a phone number database is insufficient to meet the examining attorney’s burden of proof; (2) the wording in the mark is the transliteration of Japanese words that have six possible meanings; and (3) the surname is rare.  The examining attorney has carefully considered the applicant’s arguments, but has found them unpersuasive.  For the reasons indicated below, the refusal under Trademark Act Section 2(e), 15 U.S.C. Section 1052(e) is MAINTAINED and made FINAL.

 

The applicant has contended that evidence from a phone number database is insufficient to meet the examining attorney’s burden of proof.  The applicant is advised that the entire record is examined to determine the surname significance of a term.  The following are examples of relevant considerations in determining whether or not a term is primarily merely a surname:  telephone directory listings; excerpted articles from computerized research data bases; evidence in the record that the term is in fact a surname; the manner of use on specimens; dictionary definitions of the term and evidence from dictionaries showing no definition of the term.  Further, the context in which a surname is presented may emphasize the surname significance of the term.  See, e.g., Societe Civile des Domaines Dourthe Freres v. S.A. Consortium Vinicole de Bourdeaux et de la Gironde, 6 USPQ2d 1205 (TTAB 1988) (DOURTHE held primarily merely a surname where applicant’s advertisements mentioned that term is name of a particular wine-making family); In re Etablissements Darty et Fils, 225 USPQ 652 (fed. Cir. 1985) (DARTY held primarily merely a surname based in part on evidence that term was used as “Darty et Fils” [Darty and  Son]); In re Luis Cabellero, S.A., 223 USPQ 355 (TTAB 1984) (BURDONS held primarily merely a surname based on bottles listing “James William Bourdon” and suggesting affiliation with that individual).

 

As additional evidence of the surname significance of “SAIKO,” the examining attorney attaches hereto forty-one (41) excerpted articles from a Lexis Nexis® computerized research database, and a total of eight (8) various excerpts from Genealogy.com and Ancestry.com, including social security death records, family tree excerpts and census records.

 

The applicant has argued that “SAIKO” is the transliteration of Japanese words that have six possible meanings.  The applicant is advised that, the fact that a term is a foreign word with an English translation which has no surname significance does not overcome evidence that the foreign term is perceived in the United States as primarily merely a surname.  Further, a term must be considered in its entirety.  In re Winegard Co., 162 USPQ 261 (TTAB 1969). 

 

The applicant has argued that the surname “SAIKO” is rare based on the examining attorney’s initial evidence of forty-nine (49) telephone directory listings (made of record in the first Office action).  The applicant is advised that even a rare surname may be registrable; there is no minimum number of directory listings required to establish a prima facie case for refusal of registration under Section 2(e)(4).  See, e.g., In re Industrie Pirelli S.p.A., 9 USPQ 1564 (TTAB 1988); In re Petrin Corp., 231 USPQ 902 (TTAB 1986) (twenty-four listings of Petrin as individual surname from thirteen telephone directories and nine excerpts from stories from LEXIS NEXIS found sufficient, in view of lack of any other recognized meaning for term); In re Pohang Iron & Steel Co., 230 USPQ 79 )TTAB 1986) (eleven telephone listings and twelve LEXIS NEXIS references of persons named Posten). 

 

Based on all of the foregoing, the refusal under Trademark Act Section 2(e), 15 U.S.C. Section 1052(e) is MAINTAINED and made FINAL.

 

OPTIONS TO OVERCOME SURNAME REFUSAL

 

Based on the applicant’s submission of an acceptable specimen of use which fulfills the requirements for a proper Section 1(a)/use in commerce basis, the applicant is now advised of the following options to overcome the surname refusal:

 

Proof of Distinctiveness under Section 2(f)

If the applicant believes that the mark has acquired distinctiveness, that is, that it has become a distinctive indicator of source for the goods, the applicant may amend to seek registration under Trademark Act Section 2(f), 15 U.S.C. Section 1052(f).  This Office will decide each case on its own merits.  The examining attorney will consider the following principal factors in this decision: (1) how long the applicant has used the mark, (2) the type and amount of advertising of the mark and (3) the applicant's efforts to associate the mark with the goods.  See Ralston Purina Co. v. Thomas J. Lipton, Inc., 341 F. Supp. 129, 173 USPQ 820 (S.D.N.Y. 1972); In re Packaging Specialists, Inc., 221 USPQ 917 (TTAB 1984); 37 C.F.R. Section 2.41; TMEP sections 1212, 1212.01 and 1212.06.  This evidence may include specific dollar sales under the mark, advertising figures, samples of advertising, consumer or dealer statements of recognition of the mark, and any other evidence that establishes the distinctiveness of the mark as an indicator of source. 

 

Amendment to Supplemental Register

Although the examining attorney has refused registration on the Principal Register, the applicant may amend the application to seek registration on the Supplemental Register.  Trademark Act Section 23, 15 U.S.C. Section 1091; 37 C.F.R. Sections 2.47 and 2.75(a); TMEP sections 202.02(b) and 1115.

 

OPTIONS WITH RESPECT TO FINAL REFUSAL

 

Please note that the only appropriate responses to a final action are either (1) compliance with the outstanding requirements, if feasible, or (2) filing of an appeal to the Trademark Trial and Appeal Board.  37 C.F.R. Section 2.64(a).  If the applicant fails to respond within six months of the mailing date of this refusal, this Office will declare the application abandoned.  37 C.F.R. Section 2.65(a).

But on Oct. 7, 1952, a Soviet fighter shot the plane down.  A Soviet patrol vessel recovered his body, attached to a parachute. Vasily Saiko, a sergeant in the Soviet Maritime Border Guards, removed the heavy class ring and kept it.  But Mary Dunham didn't know that. The Soviet Union denied any knowledge of the plane's fate. Mary says she struggled for her sanity.  " ...

Her daughter, Suzanne, who resembles the father she never saw, graduated from Wellesley College and from law school.  The Russian sailor, meanwhile, held on to the ring for decades. Joint Commission Late in 1993, Vasily Saiko saw a TV commercial that startled him.  This was after the Soviet Union had disintegrated and Russian President Boris Yeltsin promised to help find out about missing Americans. The Joint Commission on POW-MIA Affairs was asking Russians with information to come ... 

 

   ... Mary received a phone call with the news. A few weeks later at a Pentagon ceremony, she received the ring.  But what of his remains?  Of the eight crew members on the U.S. spy plane, Dunham's body was the only one recovered. Saiko said he was buried on the islet of Yuri, and searchers found the grave Sept. 2, 1994.  DNA tests confirmed the identity. On Aug. 1, 1995, with full military honors, Capt. Dunham's remains were buried at Arlington National Cemetery. Among those attending were Vasily and Lyuba Saiko.  For a week, they stayed with Mary and husband Don Nichols at their home near Baltimore.    Votel said the primary target of the investigation was the crew manager. Frank Douglas Saiko, 35, of 1442 Ashland Ave. in St. Paul Park, was arrested and released pending felony charges of possession with intent to distribute, Votel said. Formal charges are expected to be filed next week. 

 

   Deputies allege they found individual packages of marijuana valued at about $500 on Saiko, Votel said. 

 

   "We didn't expect to find the mother lode of dope there," Votel said of the car wash. "But it sends a pretty good message. It does shut this kind of activity down."

    Not so long ago, Josphat Saiko and his fellow Maasai warriors would have turned a blind eye to poachers, or might have been out killing animals themselves to protect crops. 

 

   Today, they guard Cape buffaloes, zebras, elephants, Thompson's gazelles, elands and wart hogs against danger and hope their efforts pay out in cash. 

 

   "They are like my goats," Saiko says of his new charges. "Why should I let anyone kill them?"

 

     ... Wildlife Sanctuary near Amboseli National Park in the shadow of Mount Kilimanjaro. 

 

   Under a new program of the Kenya Wildlife Service, the 40-acre sanctuary belongs to 840 local people rather than the government, as do Kenya's famed game parks. Saiko and the other residents now have a financial stake in the well-being of the animals. 

 

   The sanctuary is part of what David Western, director of the national wildlife protection agency, calls "a new brand of conservation." He says the concept is necessary not only to save ... 

 

   ... cross private property unmolested, the national reserves will eventually be choked off. 

 

   "The future of wildlife ultimately depends on what happens outside the parks more than (what happens) inside," he said. 

 

   At the entry-gate to the Kimana sanctuary, which opened Feb. 28, Saiko collects $10 from each non-Kenya resident and 100 shillings (about $2) from each resident to see the animals. 

 

   Saiko and his colleagues hope it will make a profit and pay dividends to the local owners. For now, the only real expense is the small salaries paid to Saiko and the other guards. The wildlife service maintains the sanctuary's roads. 

 

   A second experimental local sanctuary, also financed by the U.S. Agency for International Development, is operating at Kwale in the elephant-rich Shimba Hills forest south of Mombasa ...

    V.R.  Kobsar, an attorney here in Khabarovsk in eastern Siberia, gave us a copy of his recent letter to Dr.  Saiko, which says, in part, in respectable English: 

 

    "In summer 1946 at the age of 9, I lived in the village of Sobolevo, Vyasemsky District, Khabarovsk Region.  There was the camp of the Japanese captives in the Town of Vyasemsk.  They worked on preparing the ... 

 

   ... field in the place of the grave.  But it is impossible to eliminate the memory, this memory is about the sons, the brothers and fathers." 

 

    At this time when a new war threatens to break out with weapons of mass destruction, Mr.  Kobsar's summary words to Dr.  Saiko are worth repeating: 

 

    "The work carried out by you is aimed at the preservation of the memory of the war victims as well as the non-assumption of the mass elimination of people. 

 

    "People, friendship, mutual understanding, good-neighboring must become the real official policy of different ...
