This letter responds to Applicant’s communication filed on 1-16-04. Applicant responded by amending to the supplemental register and submitting an amendment to allege use. The assigned examining attorney has reviewed Applicant’s response and determined the following. The examining attorney has accepted Applicant’s amendment to the supplemental register, however, Applicant’s specimens submitted in the amendment to allege use are unacceptable because the examining attorney is unable to discern the mark on the goods due to the poor image quality.

Applicant must submit (1) a substitute specimen showing the mark as it is used in commerce in the sale or advertising of the services, and (2) a statement that “the substitute specimen was in use in commerce at least as early as the filing date of the amendment to allege use,” verified with a notarized affidavit or a signed declaration under 37 C.F.R. §2.20. 37 C.F.R. §§2.56 and 2.59(a); TMEP §904.09.
