Dear Tamika Whitsey,

We received an office action regarding the above-referenced matter.  It says that the Sections 8 & 15 Combined Affidavit submitted on January 10, 2010 cannot be accepted because office records show the owner is MULTIPLEX Modelltechnik GmbH. and the party who filed the Combined Affidavit is HITEC RCD USA, INC.

 

However, the PTO assignment data clearly shows that the assignment from MULTIPLEX Modelltechnik GmbH. to HITEC RCD USA, INC. was recorded after the trademark application at issue had been filed.  See the attached file.

 

Please check it out and let us know if there is any mistake on our side or we need to take any action.
