EXAMINER’S AMENDMENT

 

In accordance with the authorization granted by Henry Ward on December 2, 2003, the application has been AMENDED as indicated below.  Please note that if the identification of goods or services has been amended below, any future amendments must be in accordance with 37 C.F.R. 2.71(a); TMEP section 1402.07(e).  No response is necessary unless there is an objection to the amendment.  If there is an objection to the amendment, the applicant should notify the examining attorney immediately.

 

 

The identification of goods is amended to read as follows:

 

“pharmaceutical preparations for use in the treatment of coeliac disease, gastro intestinal health and immuno modulation; veterinary preparations for use in the treatment of coeliac disease, gastro intestinal health and immuno-modulation; dietetic substances and preparations, namely capsules, tablets and powdered preparations for use in the preparation of nutritional beverages, electrolyte beverages and sports beverages for the treatment of coeliac disease, gastro intestinal health and immuno-modulation; concentrates, syrups or powders used in the preparation of meal replacement drinks; and food for babies, food supplements and nutritional drinks, namely infant formula, follow-on formulas, nutritional supplement drinks used as meal replacement, dietary supplements in liquid form, and electrolyte drinks  in International Class 5;”

“milk and milk products, namely flavored milk, half and half; cultured and fermented milk products, namely yogurt, drinking yogurt, yogurt based beverages in International Class 29;”

 “concentrates, syrups or powders used in the preparation of soft drinks  in International Class 32.”
