This letter responds to the applicant's communication filed March 10, 2003 in which the applicant (1) submitted a renewal certificate of the Mexican Registration; and (2) submitted a substitute drawing of the mark; (3) amended the identification of goods; and (4) provided a claim of ownership. The assigned examining attorney has reviewed the applicant’s correspondence and determined the following. The substitute drawing, identification of goods and claim of ownership are acceptable.
While it appears the applicant has submitted a certificate showing that the foreign registration was renewed, such cannot be verified without an English translation of the foreign wording. The applicant must submit an English translation of the renewal certificate. The translator should sign the translation. See TMEP §§1004.01 and 1004.01(b).
The Trademark Applications and Registrations Retrieval (TARR) database on the USPTO website at http://tarr.uspto.gov provides detailed, up to the minute information about the status and prosecution history of trademark applications and registrations. Fee increase effective January 1, 2003
Effective January 1, 2003, the fee for filing an application for trademark registration will be increased to $335.00 per International Class. The USPTO will not accord a filing date to applications that are filed on or after that date that are not accompanied by a minimum of $335.00.
Additionally, the fee for amending an existing application to add an additional class or classes of goods/services will be $335.00 per class for classes added on or after January 1, 2003.
